利用規約

この利用規約（以下「本規約」）は、株式会社ANCHOR（以下「当社」）が提供するニュースアプリ「NEWSVISOR」およびウェブサイト（newsvisor.jp）その他関連サービス（以下総称して「本サービス」）の利用条件を定めるものです。利用者は、本規約に同意したうえで本サービスを利用するものとします。

第1条（適用）

1. 本規約は、利用者と当社との間の本サービスの利用に関わる一切の関係に適用されます。
2. 当社が本サービス上で掲載する個別の規定、ガイドライン等は本規約の一部を構成します。本規約とそれらが矛盾する場合は、個別の規定が優先します。
3. 法人向けサービス「NEWSVISOR INTELLIGENCE」については、当社と契約者との間で別途締結する契約が優先して適用され、当該契約に定めのない事項について本規約が適用されます。

第2条（定義）

1. 「利用者」とは、本規約に同意のうえ本サービスを利用するすべての方をいいます。
2. 「アカウント」とは、利用者がGoogleアカウント、Apple ID等を用いて本サービスに登録した利用者識別情報をいいます。
3. 「コンテンツ」とは、本サービス上で提供されるニュース記事、見出し、要約、画像、映像その他一切の情報をいいます。
4. 「AI生成コンテンツ」とは、人工知能技術を用いて自動生成される要約、翻訳、解説、分析等をいいます。

第3条（アカウント）

1. 利用者は、当社が定める方法によりアカウントを登録することで、本サービスの全部または一部の機能を利用できます。
2. 利用者は、自己の責任においてアカウントおよびログインに用いる外部サービスのアカウントを管理するものとし、第三者に利用させ、または貸与・譲渡してはなりません。
3. アカウントの不正利用により生じた損害について、当社は、当社に故意または重過失がある場合を除き責任を負いません。
4. 利用者は、アプリ内の所定の操作またはお問い合わせ窓口への連絡により、いつでもアカウントを削除できます。

第4条（本サービスの内容）

1. 本サービスは、国内外の報道機関・情報提供元が配信するニュースを収集・表示し、AI生成コンテンツ等を提供するサービスです。
2. 当社は、利用者に事前に通知することなく、本サービスの内容の追加、変更、または一部の提供の終了を行うことができます。
3. 本サービスには広告が表示されることがあります。
4. 本サービスの一部機能は有料で提供されることがあります。有料機能の料金、支払方法等は、本サービス上または各アプリストアに表示する条件によるものとします。アプリストアを通じたお支払いには、各アプリストアの規約が適用されます。

第5条（コンテンツの権利）

1. コンテンツに関する著作権その他の知的財産権は、当社、各報道機関・情報提供元またはその他の正当な権利者に帰属します。
2. 利用者は、本サービスが提供する共有機能その他当社が認める範囲を超えて、コンテンツを複製、転載、改変、配布、公衆送信、販売その他の方法で利用してはなりません。
3. 本サービスの商標、ロゴ、ソフトウェアその他に関する権利は、当社または正当な権利者に帰属します。

第6条（AI生成コンテンツについて）

1. AI生成コンテンツは、元記事の内容を自動的に要約・翻訳・解説したものであり、誤り、不正確な表現、重要な情報の欠落等を含む可能性があります。
2. 利用者は、重要な判断（投資、医療、法律、事業上の意思決定等）を行う際には、必ず元記事その他の信頼できる情報源を確認するものとします。
3. AI生成コンテンツは、当社または情報提供元の公式な見解を示すものではありません。

第7条（禁止事項）

利用者は、本サービスの利用にあたり、以下の行為をしてはなりません。

1. 法令または公序良俗に違反する行為
2. 犯罪行為に関連する行為
3. 当社、他の利用者、情報提供元その他の第三者の著作権、商標権、プライバシー、名誉その他の権利または利益を侵害する行為
4. 虚偽の情報を用いてアカウントを登録する行為、他人になりすます行為
5. コンテンツを当社が認める範囲を超えて複製・転載・再配信する行為
6. スクレイピング、クローリング、自動化ツール等により、本サービスから大量の情報を取得する行為
7. 本サービスのサーバー・ネットワークに過度の負荷をかける行為、または運営を妨害する行為
8. 本サービスのリバースエンジニアリング、逆コンパイル、逆アセンブル、改変等の行為
9. 不正アクセス、またはこれを試みる行為
10. 広告を不正にクリックする行為、その他広告配信を妨害する行為
11. 本サービスを当社の許可なく営利目的で利用する行為
12. その他、当社が不適切と合理的に判断する行為

第8条（利用停止等）

当社は、利用者が本規約に違反した場合、または当社が本サービスの運営上必要と合理的に判断した場合、事前の通知なく、当該利用者の本サービスの利用の全部または一部を停止し、またはアカウントを削除することができます。当社は、これにより利用者に生じた損害について責任を負いません。

第9条（本サービスの中断・終了）

1. 当社は、システムの保守・点検、通信障害、天災地変、外部サービスの停止その他やむを得ない事由がある場合、事前の通知なく本サービスの全部または一部を中断することができます。
2. 当社は、当社の判断により本サービスの全部または一部の提供を終了することができます。この場合、当社は可能な範囲で事前に利用者に通知します。

第10条（保証の否認）

1. 当社は、コンテンツおよびAI生成コンテンツの正確性、完全性、最新性、有用性、特定目的への適合性について、明示または黙示を問わず保証しません。
2. 当社は、本サービスが中断しないこと、不具合が生じないこと、すべての端末で動作することを保証しません。
3. 本サービス内の外部サイトへのリンク先の内容について、当社は責任を負いません。
4. 本サービスの利用に必要な通信機器、通信料金等は、利用者の負担とします。

第11条（免責・責任の制限）

1. 当社は、本サービスに関して利用者に生じた損害について、当社に故意または重過失がある場合を除き、責任を負いません。
2. 前項にかかわらず、消費者契約法その他の法令により当社の責任が認められる場合、当社の責任は、当社の故意または重過失による場合を除き、利用者に現実に生じた通常かつ直接の損害に限られ、その額は、当該損害が生じた月に利用者が当社に支払った本サービスの利用料金の額（無料の場合は1万円）を上限とします。

第12条（利用者の責任）

利用者が本規約に違反し、または不正な行為によって当社または第三者に損害を与えた場合、利用者はその損害を賠償するものとします。

第13条（個人情報の取扱い）

当社は、本サービスの利用によって取得する利用者情報を、別途定める「プライバシーポリシー」に従い適切に取り扱います。

第14条（本規約の変更）

当社は、民法第548条の4の規定に基づき、本規約を変更することがあります。変更する場合は、変更後の本規約の内容および効力発生日を、効力発生日の相当期間前までに本サービス上またはウェブサイト上で周知します。効力発生日以降に利用者が本サービスを利用した場合、変更後の本規約に同意したものとみなします。

第15条（通知）

当社から利用者への通知は、本サービス上での掲示、プッシュ通知、電子メールその他当社が適切と判断する方法により行います。

第16条（権利義務の譲渡禁止）

利用者は、当社の事前の書面による承諾なく、本規約上の地位または権利義務を第三者に譲渡し、または担保に供してはなりません。

第17条（分離可能性）

本規約のいずれかの条項が法令により無効または執行不能と判断された場合でも、本規約の残りの条項は引き続き効力を有します。

第18条（準拠法・管轄裁判所）

1. 本規約の解釈には、日本法を準拠法とします。
2. 本サービスに関して紛争が生じた場合、東京地方裁判所を第一審の専属的合意管轄裁判所とします。

第19条（言語）

本規約は日本語を正本とします。英語版は参考訳であり、日本語版と英語版の間に相違がある場合は日本語版が優先します。

Terms of Use

These Terms of Use (these "Terms") set out the conditions for using the news app "NEWSVISOR", the website (newsvisor.jp) and related services (collectively, the "Service") provided by ANCHOR Inc. ("we", "us" or "our"). By using the Service, you agree to these Terms. This English version is a translation for reference; the Japanese version prevails in case of any discrepancy.

Article 1 (Application)

1. These Terms apply to all relationships between you and us relating to the use of the Service.
2. Individual rules and guidelines we post on the Service form part of these Terms. If they conflict with these Terms, the individual rules prevail.
3. For our business service "NEWSVISOR INTELLIGENCE", the separate agreement between us and the customer prevails, and these Terms apply to matters not covered by that agreement.

Article 2 (Definitions)

1. "User" means any person who uses the Service after agreeing to these Terms.
2. "Account" means the user identification registered with the Service using a Google account, Apple ID or similar.
3. "Content" means news articles, headlines, summaries, images, videos and any other information provided on the Service.
4. "AI-Generated Content" means summaries, translations, explanations, analyses and similar output automatically generated using artificial intelligence.

Article 3 (Accounts)

1. By registering an account in the manner we specify, you may use all or part of the Service's features.
2. You are responsible for managing your account and the third-party account used to sign in, and must not let any third party use, borrow or acquire it.
3. We are not liable for damage caused by unauthorized use of your account, except in cases of our willful misconduct or gross negligence.
4. You may delete your account at any time through the in-app procedure or by contacting us.

Article 4 (The Service)

1. The Service collects and displays news distributed by news organizations and information providers in Japan and abroad, and provides AI-Generated Content and other features.
2. We may add to, change or discontinue part of the Service without prior notice.
3. Advertisements may be displayed in the Service.
4. Some features may be offered for a fee. Fees and payment methods are as shown in the Service or in each app store. Payments made through an app store are subject to that app store's terms.

Article 5 (Rights to Content)

1. Copyrights and other intellectual property rights in the Content belong to us, the news organizations and information providers, or other rightful owners.
2. You must not reproduce, republish, modify, distribute, transmit to the public, sell or otherwise use the Content beyond the sharing features of the Service or other scope we permit.
3. Rights to the Service's trademarks, logos, software and other materials belong to us or their rightful owners.

Article 6 (AI-Generated Content)

1. AI-Generated Content is an automatic summary, translation or explanation of original articles and may contain errors, inaccuracies or omissions of important information.
2. Before making important decisions (investment, medical, legal, business or similar), you must check the original article and other reliable sources.
3. AI-Generated Content does not represent the official views of us or of any information provider.

Article 7 (Prohibited Acts)

1. Acts that violate laws or public order and morals
2. Acts related to criminal activity
3. Acts that infringe the copyrights, trademarks, privacy, reputation or other rights or interests of us, other users, information providers or third parties
4. Registering an account with false information or impersonating another person
5. Reproducing, republishing or redistributing Content beyond the scope we permit
6. Obtaining large amounts of information from the Service by scraping, crawling or automated tools
7. Placing excessive load on, or interfering with the operation of, the Service's servers or networks
8. Reverse engineering, decompiling, disassembling or modifying the Service
9. Unauthorized access or attempts at it
10. Fraudulent ad clicks or other interference with ad delivery
11. Using the Service for commercial purposes without our permission
12. Any other act we reasonably consider inappropriate

Article 8 (Suspension)

If you violate these Terms, or if we reasonably consider it necessary for operating the Service, we may suspend all or part of your use of the Service or delete your account without prior notice. We are not liable for any damage you suffer as a result.

Article 9 (Interruption and Termination of the Service)

1. We may interrupt all or part of the Service without prior notice for system maintenance, communication failures, natural disasters, suspension of third-party services or other unavoidable reasons.
2. We may end all or part of the Service at our discretion. In that case, we will notify users in advance to the extent possible.

Article 10 (Disclaimer of Warranties)

1. We make no warranty, express or implied, as to the accuracy, completeness, timeliness, usefulness or fitness for a particular purpose of the Content or AI-Generated Content.
2. We do not warrant that the Service will be uninterrupted or error-free, or that it will work on all devices.
3. We are not responsible for the content of external sites linked from the Service.
4. You are responsible for the devices and data charges needed to use the Service.

Article 11 (Limitation of Liability)

1. We are not liable for damage you suffer in connection with the Service, except in cases of our willful misconduct or gross negligence.
2. Notwithstanding the preceding paragraph, where we are held liable under the Consumer Contract Act or other laws, except in cases of our willful misconduct or gross negligence, our liability is limited to ordinary and direct damage actually incurred, up to the fees you paid us for the Service in the month the damage occurred (or JPY 10,000 if the Service was free).

Article 12 (User Responsibility)

If you cause damage to us or a third party by violating these Terms or through wrongful acts, you shall compensate for that damage.

Article 13 (Personal Information)

We handle user information obtained through the Service in accordance with our Privacy Policy.

Article 14 (Changes to These Terms)

We may change these Terms in accordance with Article 548-4 of the Civil Code of Japan. When we do, we will announce the revised Terms and their effective date on the Service or our website a reasonable period before they take effect. If you use the Service after the effective date, you are deemed to have agreed to the revised Terms.

Article 15 (Notices)

We give notices to users by posting on the Service, push notifications, email or other methods we consider appropriate.

Article 16 (No Assignment)

You may not assign or pledge your position or rights and obligations under these Terms to any third party without our prior written consent.

Article 17 (Severability)

If any provision of these Terms is held invalid or unenforceable under law, the remaining provisions continue in full force.

Article 18 (Governing Law and Jurisdiction)

1. These Terms are governed by the laws of Japan.
2. The Tokyo District Court shall have exclusive jurisdiction as the court of first instance for any dispute relating to the Service.

Article 19 (Language)

The Japanese version of these Terms is the original. The English version is a reference translation, and the Japanese version prevails in case of any discrepancy.
